1. Overview

Coloquio respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and its safe harbor provisions (17 U.S.C. § 512), we have established the following procedure for reporting content that infringes copyrights.

2. Reporting Infringing Content (DMCA Notice)

If you believe that content posted on Coloquio (event images, descriptions, profile pictures) infringes your copyright, send a written notice to our Designated Agent with all of the following information:

  1. Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed.
  2. Identification of the infringing material — The exact URL or a detailed description of where the material is located within coloquio.space or the Coloquio application.
  3. Contact Information — Your full name, mailing address, telephone number, and email address.
  4. Good Faith Statement — A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy — A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.
  6. Signature — Your physical or electronic signature.

3. Removal Process

Once a valid and complete notification is received:

  1. Within 48 business hours: We will remove or disable access to the reported content.
  2. User Notification: We will inform the user whose content was removed about the received notification.
  3. Record Keeping: We will keep a record of the notification as required by the DMCA.

4. Counter-Notification

If your content was removed by mistake or misidentification, you may send a counter-notification to our Designated Agent that includes:

  1. Your full name, mailing address, telephone number, and email address.
  2. Identification of the material that was removed and the location at which the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the U.S., for any judicial district in which Coloquio may be found).
  5. Your physical or electronic signature.

Upon receiving a valid counter-notification, we will notify the original complaining party. If the complaining party does not file a court action within 10 business days, we may restore the removed content at our discretion.

5. Repeat Infringer Termination Policy

In accordance with the DMCA, Coloquio has a termination policy for users who are repeat infringers. Accounts that accumulate multiple confirmed copyright violations will be suspended or permanently deleted.

6. Fair Use

Before sending a DMCA notice, consider whether the use might be protected under the fair use doctrine or other applicable copyright exceptions. False or bad faith notifications can lead to legal liability for the complaining party.
